1. General
Definitions
Housing seekers:
Private person, with the purpose to finding a home for own use. It could also be companies, seeking on behalf of employees.
Landlords:
Private person/company, that advertises and rents/administrates the accommodation. There are two types of landlords, cf. Danish legislation:
- Private landlord: Have a maximum of 1 lease of all- or part of own residence.
- Professional landlord: Has more than 1 lease. It is not conditional on the landlord having all tenancies for letting/registered on Boliglejen.dk.
Login:
Your personal registered account, either via social media or register form. Consists of your e-mail address and password as a minimum. All actions on Boliglejen.dk is associated with this login.
Information/data:
Advertisement texts, details of tenancies, images, contact information in any form (phone, e-mail etc.) and dialogues from the internal messaging system.
Terms and agreement
Use of Boliglejen.dk is subject to these terms and conditions, as described on this page. It is considered an acceptance of these terms by using Boliglejen.dk, including:
- By login.
- By filling out profile.
- By contacting landlord(s).
- By writing new messages, in the internal message system.
- By advertising.
- By creating a housing agent.
Boliglejen.dk reserves the right to update and change the terms, as necessary, including the personal data and cookie policy. Changes will be announced on Boliglejen.dk. Continued use of Boliglejen.dk after changes, will be considered an acceptance of those changes.
The same terms and conditions also apply to both private and professional landlords.
The time of acceptance of terms can always be seen under menu item "Settings" (requires login).
Right of use
Your login on Boliglejen.dk is personal and therefore must not be lent, passed on or sold to others, just as it is not permitted to pass on information/data, which is only available behind login.
Information/data on Boliglejen.dk is copyrighted and may only be used in the context and form for which it is intended, pursuant to that service Boliglejen.dk offers.
Same information/data may not be "scraped" (copied), either for commercial purposes or in competitive business use.
It is permitted to share advertisements, in the form in which they are available to others without login, e.g. by using the sharing methods Boliglejen.dk offers, as long as it does not conflict with aforementioned conditions.
For messages, in the internal message system, the law on letter secrecy in Straffelovens §263 paragraph 1. applies
Processing of personal data
All points regarding processing of personal data, which is also part of this agreement, is described in more detail here: Privacy Policy.
Especially for dialogue between users: You can communicate freely via Boliglejen.dk' internal message system, regarding the specific tenancy etc. as long as it does not violate the points below. In addition, the dialogue is covered by the Straffelovens §263 paragraph 1. which deals with letter secrecy.
The dialogue between landlords and home seekers must not contain demands for services and products, such as offers for advertising tenancies outside Boliglejen.dk.
Special offers, "money under the table" etc. will be reported and lead to exclusion from our service. As this is seen as a breach of the agreement, refunds of any purchases will be excluded.
We reserve the right to read and store the dialogue between users. This is for reasons of security, evidence in disputes and user experience.
The dialogue between landlord and home seeker belongs to both parties and. It is included as documentation for any rental agreement entered into. Therefore dialogues cannot be required to be deleted or edited. The only reason for deleting dialogue is if one/both party/parties was to delete their account(s) and the limitation period of 2 years expires.
However, we encourage both parties to ensure that all agreements are documented in a valid lease contract, rather than rely on messages alone.
Spamming others - be it with irrelevant messages, or simply an unreasonable amount of messages with relation to the dialogue, and this is reported by the other party, it will lead to exclusion from Boliglejen.dk. This does not cover the use of language - but we encourage you to maintain a good tone.
Sensitive personal information should NOT be shared in the internal messaging system, as Boliglejen.dk cannot guarantee that the recipient(s) can or have the capability to handle this information in a lawful/confidential manner.
2. Landlords
Landlord's obligations
When advertising leases on Boliglejen.dk, you commit to maintain and correct the information for the tenancy. Including contact information, mark the rental as leased/inactivated when the rental is no longer available, etc.
In addition to the above, all rental advertisements will be automatically deactivated after being active for a period of one month. This policy aims to maintain the relevance of content for tenants looking for rental properties.
It is not allowed to advertise, or in any other way attempt to move customers over to one's own or others' advertising media/platforms. All dialogue should focus on the specific rental property and must take place through the methods provided by Boliglejen.dk.
Advertisements are made visible on search engines such as Google. References from here, to the advertisement, are interrupted the moment the home is marked as rented or deactivated in any other way.
You're permitting that Boliglejen.dk reads and edits ads, by adverticing via our services. Additionally you permit us to contact you, on behalf of this validation process.
Advertising guidelines
Boliglejen.dk does not allow ad texts with offensive, hostile, racist, discriminatory, content with political messages or content that aims to spread irrelevant or unwanted messages that go beyond the purpose of Boliglejen.dk.
By the Equality Act (Ligestillingsloven), it is not permitted to advertise for tenants of a certain ethnicity or gender, if we are talking about renting out the entire home. However, when subletting rooms/parts of a home, the lessor may choose according to gender - as the private form of the rental agreement does not fall under this area of law.
Advertisement texts must not contain telephone numbers, e-mail addresses, addresses or other contact information (e.g. internet addresses).
Boliglejen.dk does not allow the advertising of leases where takeover is conditional on the purchase of products, the provision of services (caretaker functions not included) or "money under the table".
It is not permitted to create multiple ads for the same rental property. Boliglejen.dk has also technically implemented a system that counters this in most cases - if not all.
Boliglejen.dk is for home seekers/landlords, which is why commercial leases are rejected if it does not include housing.
Sales, exchange of housing, warehouse/storage, parking etc. does not meet advertising requirements.
An advertisement represents one (1) vacant tenancy where occupancy is the advertised date. In addition, the rental is on a monthly basis, for a minimum of 1 month.
The assessment of whether the advertisement violates these guidelines is made by Boliglejen.dk, whom reserves the right to edit, delete passages or cancel/remove the advertisement. Advertisers who violate these guidelines, intentionally or to an unreasonable degree, may end up being rejected from using Boliglejen.dk' services. But never without prior dialogue.
Advertising & partners
By accepting Boliglejen.dk's terms, it is also agreed that Boliglejen.dk may use/refer to residences advertised on our website for marketing purposes - including sharing with partners. Information/data used is solely the same as accessible without login. That is, contact details are not included in advertising relationships. However, partners may receive contact details to the extent necessary to provide personalized service.
Contact info & login
When you create an account with Boliglejen.dk, the username will basically consist of your email address. In addition, a password will also need to be created, unless you make use of Facebook login or similar.
We recommend the creation of a separate e-mail address for login and contact option for ads.
Why? Partly because you must not share your Login with others (as described earlier in this agreement). But also for safety reasons. Despite the password protection, we consider it a significant deterioration of (your) security, should you use the same e-mail address as a contact option for your rentals/advertisements, as used for your login.
Boliglejen.dk has therefore made it a technical impossibility to use the same e-mail, so that it does not happen by mistake.
We highly encourage you to log out at the end of any visit if you visit Boliglejen.dk on a publicly accessible device. This ensures that others cannot access your login for a short period of time after your use. See possibly more under Cookies.
3. Lease contracts
Responsibility
Boliglejen.dk disclaims any responsibility for the legality of lease contracts entered into, between any landlord and tenant/housing seeker. Boliglejen.dk can therefore not be held responsible for direct or indirect losses as a result of lease contracts entered into.
However, we strongly recommend that you (regardless of whether you are a landlord or a home seeker) familiarize yourself with the current Tenancy Act (Lejeloven) before preparation/entering into a lease contract.
Furthermore: Agreements etc. entered into through our message system, between housing seeker and landlord, do not replace a valid lease contract. We therefore encourage to secure all agreements in a lease contract, so that both parties are secured their right.
Boliglejen.dk is working on offering new services, over time, with a focus on this- as well among other things.
4. E-mails
Subscriptions/cancellations
When you create a Login on Boliglejen.dk, you also agree to receive emails from us, including emails about relevant tenancies (when creating a search agent).
Unsubscribing from search agent emails: Go to the menu item "Search agents" (requires login) and individually delete the search agents you no longer wish to receive emails for. If you want to keep search agents, but not receive other email notifications, you must follow the procedure below.
Unsubscribing from e-mails more generally: Go to the menu item "Settings" (requires login) and adjust permissions as needed.
